The FDA has the legal authority to regulate tobacco products containing nicotine from any source, including synthetic nicotine. One study detected vitamin E acetate in the lung fluid of 48 out of 51 EVALI patients sampled across 16 states. By contrast, lung fluid samples taken from healthy people did not contain the vitamin.
